This page explains how SaaufAI handles reports and restrictions, as required by the EU Digital Services Act (DSA) and the US Digital Millennium Copyright Act (DMCA). It is part of the Terms of Service.
Points of contact
Users, authorities, the European Commission and the European Board for Digital Services can reach us at ai@saauf.xyz. We read messages in English and Polish.
Report illegal content or misuse
To report content you believe is illegal or breaks our policies (for example a public App in the Marketplace, or an email sent by a Wisp), email ai@saauf.xyz with:
- Where the content is: a link, the App's name, or the sending address and date of the email.
- Why you think it is illegal or against our policies, with enough detail for us to check.
- Your name and email address (not needed if you report child sexual abuse material).
- A statement that you believe in good faith that the report is accurate and complete.
We confirm we received it, look at it carefully and objectively, and tell you what we decided and how you can contest it. We tell you if any part of the decision was automated. If the content suggests a threat to someone's life or safety, we inform the authorities.
Copyright (DMCA)
Send copyright notices and counter-notices through the copyright portal, which asks for everything the law requires, or email them with the same information to ai@saauf.xyz. A notice must include:
- Your physical or electronic signature (in the portal, typing your full legal name).
- The copyrighted work you claim is infringed (or, for several works, a representative list).
- The material you claim is infringing and where it is, in enough detail for us to find it.
- Your address, phone number and email address.
- A statement that you believe in good faith the use is not authorised by the owner, its agent or the law.
- A statement that the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for them.
We email you a reference, review the notice, and remove or disable the material if it is valid. We tell the person concerned, with a statement of reasons and a copy of the notice (your name and organisation, but not your address or phone number).
If your material was removed and you believe it was a mistake or misidentification, send a counter-notice through the portal with your contact details, a description of the removed material and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, and your consent to the jurisdiction of the Federal District Court for your address (or, outside the US, any judicial district where we may be found) and to accept service from the sender of the notice. We forward it in full to the sender of the notice and restore the material 10 to 14 business days later, unless they tell us first that they have filed a court action.
Repeat infringers. We disable accounts with 3 upheld copyright notices within 12 months (notices reversed by a counter-notice don't count). Knowingly false notices or counter-notices can make the sender liable for damages under 17 U.S.C. § 512(f).
When we restrict something
If we remove or restrict content, pause Wisps, unpublish an App, revoke keys or disable an account, we tell you (unless the law forbids it or it would put someone at risk), with a statement of reasons: what we did and for how long, the facts it was based on, whether it was found or decided by automated means, the law or policy we relied on, and how you can appeal.
Appeals
- A disabled account can appeal from the appeal page it sees when it signs in, up to 3 times, one at a time. It can attach copies of its own data (such as a Wisp conversation, a Wisp's emails, Wisp settings, recent usage or credit history) for the person reviewing it.
- For any other decision, including a decision on a report you sent, reply to our message or email ai@saauf.xyz.
- You can appeal for at least 6 months after the decision. A person reviews every appeal, and we tell you the outcome and reasons.
- You can also turn to a certified out-of-court dispute settlement body under the DSA, or to a court.
Misuse of reports
If someone often sends reports or appeals that are clearly unfounded, we may stop processing them for a while, after a warning.
